1. Activity. I understand that the participant named above will take part in swimming instruction, aquatic skill practice, water-safety activities, and related activities provided by Hannah D. Tarr, doing business as or in connection with Swim307 (collectively, the “Swim307 Parties”).
2. Acknowledgment of aquatic risks. I understand that swimming and aquatic instruction involve inherent and other risks, whether known or unknown. These risks may include drowning or near-drowning; water aspiration; slips, trips, and falls; collision with walls, lane lines, pool equipment, instructors, or other participants; diving or jumping injuries; muscle strains and other physical-exertion injuries; sudden illness or medical events; exposure to water-treatment chemicals or communicable illness; and risks created by weather, facilities, equipment, water depth, visibility, or the actions of other persons. Serious injury, permanent disability, or death can occur.
3. Voluntary participation and assumption of risk. Participation is voluntary. I knowingly and voluntarily accept and assume all inherent risks of the activity and all other risks that are reasonably related to participation, to the fullest extent permitted by Wyoming law. I am responsible for informing Hannah D. Tarr of any limitation that may affect safe participation before a lesson begins.
5. Parent or guardian provisions. If the participant is a minor, I sign as the participant’s parent or legal guardian. I consent to the minor’s participation, acknowledge the risks described in this agreement, waive and release my own claims arising from the minor’s participation to the fullest extent permitted by Wyoming law, and agree that any release of the minor’s claims applies only to the extent Wyoming law permits a parent or guardian to make such a release.
6. Emergency medical care. If I am unavailable or unable to provide consent during an emergency, I authorize Hannah D. Tarr or another responsible person to obtain or request emergency medical assistance for the participant when reasonably believed necessary. I understand that Swim307 does not guarantee the availability or outcome of medical care and that I am responsible for costs of care not otherwise covered.
7. Swimming ability and instructions. I will provide accurate information about the participant’s swimming ability and will follow reasonable safety instructions. I understand that swim instruction reduces some risks but cannot eliminate the risk of injury or drowning.
8. Wyoming law; severability. This agreement is governed by Wyoming law. If any provision is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
9. Knowing agreement. I have read this entire agreement before signing it. I understand that it affects legal rights, including the right to bring certain negligence claims. I have had the opportunity to ask questions and to seek legal advice. I sign voluntarily and understand that participation may be declined if I do not wish to sign.
